3. Purpose of the data processing:

Commencing, carrying out, terminating or settling an employment, processing other organisational, personnel and social measures, especially for the purpose of personnel recruitment, planning, deployment and development.

4. Legal framework for the processing of personal data:

Art. 6 para. 1 lit. b and c, Art. 88 GDPR in conjunction with § 6 para. 2 No. 5 Act on the Autonomy of Institutions of Higher Education in the Free State of Saxony (SächsHSFG) and § 11 Saxon Act on the Enforcement of Data Protection (SächsDSDG) and the service agreement for the use of standard software SAP at TU Dresden.

5. Data transfer / Disclosure:

The transfer/disclosure of data within TU Dresden or to other offices in the operating area of the Saxon State Ministry of Higher Education, Research and the Arts, as well as to the State Bureau of Taxation and Finance, only occurs if it is necessary for the purpose stated in no. 3 or legally required. Data will only be transferred/disclosed to other third parties if it is necessary for the purpose stated in no.3 and to fulfill a legal obligation (in particular contracts with third party funding partners, grant confirmations – SAB/ESF, etc.) or if the transfer of data according to § 6 para. 1 sentence 2 of the Saxon Act on the Enforcement of Data Protection (SächsDSDG) shall occur on the basis of a legitimate request from a public body or if the concerned party has consented to data transfer/disclosure in individual cases.

6. Storage period or criteria to determine the storage period:

Personal data is saved/stored for as long as it is necessary for the purpose stated in no.3, i.e. unless it is otherwise stipulated in special legal provisions – at least up until the legal termination of employment or the end of other organisational, personnel or social measures.

Personnel file data is saved/stored for a further five years after the termination of employment or legal closing of the personnel file by the office responsible for personnel administration – unless otherwise stipulated in a special legal provision that particular data is to be stored for a longer or shorter period of time. At the same time, the legal storage period for business documents applies, especially the terms of the trade, tax and insurance guidelines according to the Commercial Code (Handelgesetzbuch, HGB), Fiscal Code (Abgabenordnung, AO) and the Fourth Book of the Code of Social Law (Sozialgesetzbuch Viertes Buch, SGB IV).

After the aforementioned storage periods have expired, the personnel file/personnel file data is stored in the University Archive in  accordance with the archiving regulations of the Free State of Saxony. Further provision, evaluation and other application of the data is only permitted in compliance with the special archiving regulations. The application documents of unsuccessful applicants will be saved/stored for six months after the selection procedure.

7. Your rights as the data subject:

You have the following rights provided that the legal requirements are met:

  • Right to the correction of inaccurate personal data (Art. 16 GDPR)
  • Right to the deletion of personal data (Art. 17 GDPR)
  • Right to limiting the processing of personal data (Art. 18 GDPR)
  • Right to object to the processing of personal data (Art. 21 GDPR)

8. Right to complain to the Supervisory Authority:

According to Art. 77 GDPR, you have the right to complain to the Supervisory Authority if you are concerned that your personal data is not being handled correctly.
